Terms of Service

1. Acceptance of Terms

By accessing or using any courses, coaching, community platforms, tools, calculators, simulators, PDFs, scripts, contracts, videos, or affiliate links provided by Equivest Academy LLC, including Wholesaling 101 and Financial Market Mastery, you agree to be bound by these Terms of Service ("TOS"), our linked Privacy Policy, Refund & Subscription Policy, Course-Specific Disclaimers, Affiliate Disclosure, and Copyright/IP Policy. If you do not agree, you may not access or use our services.

2. User Accounts & Subscription

• Access to courses and coaching requires registration and payment of applicable fees.
• Your subscription to courses or coaching programs (e.g., $149/month) auto-renews monthly until canceled.
• You may cancel at any time through your account. Cancellation prevents future charges but does not retroactively refund prior payments except as explicitly stated in our Refund Policy.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Acceptable Use & Community Rules

You agree to use all courses, tools, coaching, and community platforms provided by Equivest Academy LLC responsibly and lawfully. Prohibited conduct includes, but is not limited to:

• Sharing or distributing any course materials, PDFs, scripts, contracts, or videos outside permitted use
• Posting spam, harassing, defamatory, abusive, or illegal content in any community platform, including Discord
• Attempting to hack, copy, scrape, or otherwise disrupt Equivest Academy LLC systems or third-party integrations
• Using the courses or tools for any purpose that violates local, state, or federal law

Violation of this policy may result in immediate termination of access, removal from community platforms, and legal action if warranted.

4. Payment Processor Compliance

All payments for courses, coaching, and services are processed by Stripe and Systeme.io, which are third-party payment processors. By using these services, you agree to comply with the respective terms of service, rules, and acceptable use policies of these processors.

You understand that Equivest Academy LLC does not control the processing of payments and is not liable for delays, failures, or errors caused by payment processors. Any refunds, disputes, or billing issues must first comply with our Refund Policy and the policies of the payment processor.

5. Chargeback & Payment Dispute Policy

By enrolling in courses or coaching programs with Equivest Academy LLC, you acknowledge and agree that all payments are final except as stated in our Refund Policy.

Initiating a chargeback, dispute, or reversal of payment outside of the stated Refund Policy constitutes a breach of these Terms. Equivest Academy LLC reserves the right to:

• Suspend or terminate your access to courses, coaching, and community
• Pursue collection of fees, costs, and damages arising from the chargeback or reversal
• Report abuse to payment processors, including Stripe and Systeme.io

You expressly agree to indemnify and hold harmless Equivest Academy LLC and its affiliates from any losses, fees, or damages caused by unauthorized chargebacks or payment disputes.

6. Limitation of Liability / Use at Your Own Risk

By accessing or using the courses, coaching, community, tools, calculators, simulators, PDFs, scripts, contracts, videos, and affiliate links provided by Equivest Academy LLC, including Wholesaling 101 and Financial Market Mastery, you acknowledge and agree to the following:

All content, tools, coaching guidance, and community interactions are provided for educational purposes only. You assume full responsibility for your actions, decisions, and results based on the information or guidance provided.

No Guarantees

Equivest Academy LLC makes no guarantees regarding the accuracy, completeness, or effectiveness of any materials, coaching, simulations, calculators, templates, or strategies. Equivest Academy LLC does not guarantee profits, successful transactions, trading outcomes, or any specific results.

Limitation of Liability

To the maximum extent permitted by law, Equivest Academy LLC, its owners, employees, affiliates, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, revenue, data, or use, resulting from or related to:

• Accessing or using course content or tools
• Participation in coaching sessions or joint venture guidance
• Use of scripts, contracts, PDFs, or simulators
• Actions taken based on guidance or information provided
• Participation in community discussions (including Discord)
• Use of any third-party products or affiliate tools

Student Responsibility

You are responsible for performing due diligence, complying with local, state, and federal laws, and consulting licensed professionals as appropriate before executing any real estate transactions, trading activities, or other business decisions.

By enrolling in courses, paying for coaching, or using any materials from Equivest Academy LLC, you acknowledge that you fully understand and accept this limitation of liability.

7. Arbitration Clause

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or related to the courses, coaching, tools, calculators, simulators, PDFs, scripts, contracts, videos, affiliate links, community interactions, or any other services provided by Equivest Academy LLC, including but not limited to alleged breach of contract, misrepresentation, or negligence, shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its commercial arbitration rules.

The arbitration shall be conducted in Phoenix, Arizona, unless the parties mutually agree otherwise.

By agreeing to these Terms of Service, you waive any right to participate in a class-action lawsuit, representative action, or any form of consolidated action. The arbitration decision shall be final and binding, and judgment may be entered in any court having jurisdiction.

This clause survives termination of your access to courses, coaching, tools, and community platforms.

8. Governing Law & Jurisdiction

These Terms of Service, all courses, coaching, tools, simulators, PDFs, community interactions, and related services are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles.

Any disputes not subject to binding arbitration will be resolved in the courts of Maricopa County, Arizona, and you consent to exclusive jurisdiction and venue in those courts.
